Welcome to Red White and Brew Coffee Company (“we,” “us,” “our,” or “Red White and Brew”). These Terms of Service (“Terms”) govern your access to and use of our website located at https://redwhiteandbrew.org (the “Site”), our mobile applications (if any), and any related services, including the purchase of coffee, tea, merchandise, and participation in giveaways (collectively, the “Services”).

By accessing or using the Services, you agree to be bound by these Terms. If you do not agree with any part of these Terms, you must not use the Services.

1. Eligibility

You must be at least 18 years old (or the age of majority in your jurisdiction) to use the Services. By using the Services, you represent and warrant that you meet this age requirement and have the legal capacity to enter into these Terms.

2. Accounts

To make purchases or participate in giveaways, you may need to create an account. You agree to provide accurate, current, and complete information during registration and to update it as necessary. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. Notify us immediately of any unauthorized use.

3. Products and Orders

All products are subject to availability.
We reserve the right to refuse or cancel any order at our sole discretion, including orders that appear fraudulent or contain errors.
Prices are in USD and exclude taxes and shipping unless otherwise stated. We reserve the right to change prices at any time.
Title and risk of loss pass to you upon delivery to the carrier.
Food Products (coffee, tea, etc.) are perishable and roasted/fulfilled to order. All food sales are final.
Print-on-Demand Merchandise is custom-made to order and non-returnable except as provided in our Return Policy.

4. Shipping & Delivery

We offer free standard shipping within the continental United States.
Coffee and tea products typically ship within 2–5 business days (roasted to order).
Print-on-demand items typically take 7–10 business days for production before shipping.
Delivery times are estimates only and may be affected by carriers, weather, holidays, or other factors beyond our control.
We are not liable for delays, lost packages, or issues caused by the carrier after handover.

5. Returns & Refunds

Our Return Policy is incorporated into these Terms by reference. In summary:

No returns or refunds on food items or print-on-demand products for change of mind.
Damaged or incorrect items must be reported immediately via our Contact Us form with photos.
If we are at fault (wrong item shipped, etc.), we will replace the item or issue store credit at our discretion.
No cash refunds except as required by law.

6. Giveaways & Promotions

All giveaways are governed by separate Official Rules posted on the Site.
Entry via purchase is automatic (1 entry per $1 spent, excluding taxes/shipping).
Alternate Method of Entry (AMOE) is available as described in the rules—no purchase necessary.
Prizes are awarded as-is; winners are responsible for taxes, fees, title/registration (vehicles), and compliance with laws.
We reserve the right to disqualify fraudulent entries or modify/terminate promotions.

7. Intellectual Property

All content on the Site (text, graphics, logos, images, designs, software) is owned by Red White and Brew Coffee Company or our licensors and protected by copyright, trademark, and other laws. You may not reproduce, distribute, modify, or create derivative works without our prior written permission.

Our trademarks (including “Red White and Brew,” the eagle logo, and related marks) may not be used without permission.

8. User Conduct

You agree not to:

Use the Services for any unlawful purpose.
Transmit viruses, malware, or harmful code.
Attempt to gain unauthorized access to the Site or accounts.
Harass, impersonate, or interfere with others.
Scrape, crawl, or data-mine the Site.

We may terminate or suspend your access for any violation.

9. Limitation of Liability

To the fullest extent permitted by law, Red White and Brew Coffee Company, its owners, officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Services, even if advised of the possibility of such damages.

Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.

10. Indemnification

You agree to indemnify, defend, and hold harmless Red White and Brew Coffee Company and its affiliates from any claims, losses, liabilities, damages, costs, and expenses (including reasonable attorneys’ fees) arising from your use of the Services, violation of these Terms, or infringement of third-party rights.

11. Governing Law & Dispute Resolution

These Terms are governed by the laws of the State of Texas, without regard to conflict of law principles.

Any dispute arising out of or related to these Terms or the Services shall be resolved exclusively by binding arbitration administered by JAMS under its Streamlined Arbitration Rules & Procedures in Hardin County, Texas. You waive any right to a jury trial or class action. Small claims actions may be brought in Hardin County courts.

12. Changes to Terms

We may update these Terms at any time. The updated version will be posted here with a revised effective date. Your continued use of the Services after changes constitutes acceptance.
